In Re Aoyama, 2010-1552
In an appeal from the affirmance by the Board of Patent Appeals of the examiner's rejection of certain claims as anticipated by a patent application and concerning a system and method for distribution chain management, judgment of the Board is affirmed on an alternate ground where subject claims failed to satisfy the definiteness requirement of 35 U.S.C. section 112 even though the Board erred in construing the means-plus-function limitation of the claims.
