CBT Flint Partners, LLC v. Return Path, Inc., 2010-1202
In a patent dispute concerning to the validity of certain methods and systems for charging a fee for sending spam email, judgments of the district court are reversed where the court erred in failing to exercise its authority to correct a supposed error found in subject claim by granting summary judgment on the basis of indefiniteness, 35 U.S.C. section 112, and because the court improperly awarded defendants costs including e-discovery costs, 28 U.S.C. section 1920, but otherwise affirmed.
