In Re NTP, Inc, 2010-1277

In an appeal from decisions of the USPTO Board of Patent Appeals and Interferences (Board) affirming the rejections of certain claims relating to a system for sending electronic information, judgment of the Board is affirmed where: 1) the Board's claim construction of destination processor was correct; 2) priority can be considered and determined during reexamination proceedings; and 3) the priority determination was proper because the examiner did not consider priority during the original prosecution.
