United States Federal Circuit
In Re NTP, Inc., 2010-1243
In an appeal from decisions of the USPTO Board of Patent Appeals and Interferences (Board) affirming the rejections of certain claims relating to a system for sending information, judgment of the Board is reversed where its construction of the term "electronic mail message" was unreasonably broad, but affirmed where it properly held that appellant failed to “swear behind” certain references and that Telenor, an eight-volume publication titled “Mobile Data Net-works Description,” is a printed publication under 35 U.S.C. Section 102(b).
