In a false marking qui tam action alleging the unauthorized use of an embodied firewall by defendant, Rule 12(b)(6) dismissal by district court is affirmed where plaintiff failed to plead sufficient facts showing that defendant marked an unpatented article within the meaning of 35 U.S.C. section 292.
