Wellman, Inc v. Eastman Chemical Co., 2010-1249
In a patent infringement dispute involving polyethylene terephthalate (PET) resins for use in plastic beverage containers, summary judgment by district court on the grounds of failure to disclose the best mode and indefiniteness is affirmed in part and reversed in part where the specifications of patents do not set forth the best mode of carrying out the invention as contemplated by at least one of the inventors although a person of ordinary skill could understand the bounds of the patent claims.
