United States Federal Circuit

San Carlos Apache Tribe v. US, 2010-5102

In an action for breach of fiduciary duty under the Tucker Act, 28 U.S.C. section 2501, and relating to water rights in the Gila River, judgment of the district court dismissing claim as time-barred is affirmed because action first accrued when all the events underpinning liability occurred, beyond the limitations period, even though plaintiff did not have actual knowledge of all the relevant facts.
