Preminger v. Sec'y of Veterans Affairs, 2009-7044
In an issue of first impression, 38 U.S.C. section 502 does confer jurisdiction on the court to review a denial by the Secretary of Veterans Affairs of a petition for rulemaking, even though the action is not expressly provided for by the review statute. Petition for review of the Secretary's denial of petition for rulemaking is denied.
