SKF USA Inc. v. US, 10-1128
The decision of the Court of International Trade, affirming the final determination of the United States Department of Commerce in its seventeenth administrative review of antidumping duty orders on ball bearings and parts thereof from France, Germany, Italy, Japan, Singapore and the United Kingdom, is affirmed in part, vacated in part and remanded where: 1) the Trade Court's decision that Commerce has the authority to use unaffiliated suppliers' actual costs of production in calculating constructed value (CV) and to utilize zeroing is affirmed; but 2) the Commerce in two respects did not provide a reasonable explanation for its decision to depart from its methodology after sixteen reviews.
