In a patent infringement suit related to patents for cochlear implants, dismissal of the case for lack of standing to sue on the ground that plaintiff's 2004 agreement with a third party granting an exclusive license to the patents at issue was a virtual assignment of the patents-in-suit, is reversed as plaintiff is the sole owner of the patents-in-suit because it retained substantial rights in the patents, including the right to sue for infringement if the third party declines to do so.
