Crash Dummy Movie, LLC v. Mattel, Inc., 09-1239
In The Crash Dummy Movie, LLC's (CDM) application to register the mark CRASH DUMMIES for a line of games and playthings, decision of the Trademark Trial and Appeal Board sustaining Mattel, Inc.'s challenge is affirmed as substantial evidence supports the Board's finding that Mattel intended to resume use of the CRASH DUMMIES marks during the period of non-use.
