In re Suitco Surface, Inc., 09-1418
The decision of the United States Patent and Trademark Office (PTO), rejecting certain claims of '514 patent, related to floor finishing material for use on athletic courts, bowling alleys, and other floor surfaces, as anticipated during a reexamination proceeding is affirmed in part, vacated in part and remanded where: 1) the PTO based its rejection on its unreasonable construction of the phrase "material for finishing the top surface of the floor"; but 2) substantial evidence supports the PTO's finding with respect to the "uniform" limitation.
