Bastien v. Shinseki, 09-7099
Decision of the Veteran's Court affirming the decision of the Board of Veterans' Appeals that the death of claimant's husband did not result from his military service is affirmed where: 1) claimant's substantive contentions involve factual issues that the court has no jurisdiction to review; 2) a recent decision of the court requires rejection of claimant's contention that the Board improperly relied on the Department's medical witnesses because it did not affirmatively establish their qualifications as medical experts; and 3) claimant's contention that the Veterans Court improperly struck the initial version of her opening brief for violating its procedural rule against citation of its nonprecedential opinion is rejected.
