In a patent infringement action relating to patents for a medical device known as an introducer, which is a device that permits a surgeon to place and remove catheters or pacemaker leads into blood vessels during surgical procedures, a finding of infringement of the patent is affirmed in part, reversed in part and remanded where: 1) the record supports the district court's denial of defendant's motions for JMOL and leave to amend its answer; and 2) district court's finding of infringement is vacated as the record does not support the district court's claim construction.
