Epistar Corp. v. Int'l Trade Comm'n, 07-1457
In a patent infringement action involving a light emitting diode, International Trade Commission judgment is affirmed in part and reversed in part where: 1) the Commission erred in estopping plaintiff from arguing invalidity of the patent owned by defendant Philips as to its products; 2) the Commission correctly construed the claim terms "transparent window layer" and "substrate" in the patent; and 3) the Commission erred in extending the limited exclusion order to downstream products manufactured by third parties not named in the case.
