Erbe Elektromedizin GMBH v. Int'l Trade Comm'n, 08-1358
In a patent infringement action involving electrosurgery by argon plasma coagulation probes, International Trade Commission judgment for defendant is affirmed where the Commission properly found that there was no direct infringement and thus no basis for finding induced or contributory infringement, as plaintiff presented no evidence that any accused device had been used with an endoscope that had at least two "working channels," which the parties agreed was necessary to find infringement.
