Adamsen v. Dept. of Agric., 08-3222
In an action challenging an employment termination, Merit Systems Protection Board's affirmance of plaintiff's removal by the Department of Agriculture is vacated and remanded for further proceedings where the record is inadequate to determine whether the Office of Personnel Management had approved the performance appraisal system under which the removal was effected as required. The remaining portions of the challenged Board decision are affirmed.
