Princo Corp. v. Int'l Trade Comm'n, 07-1386
In a patent infringement action involving compact disc technology, International Trade Commission order against plaintiff is affirmed in part and vacated and remanded in part where: 1) plaintiff failed to meet its burden of demonstrating that the patents in question are unenforceable due to patent misuse on the grounds of unlawful tying; and 2) the Commission's analysis of the agreement issue was predicated on legal errors in several respects, and the Commission erred in failing to determine whether plaintiff established that such an agreement existed.
