Tohono O'odham Nation v. US, 08-5043

In an action involving the management of Native American trust assets, Court of Federal Claims' grant of defendant's motion to dismiss for lack of jurisdiction is reversed where plaintiff's complaint in the Court of Federal Claims seeks relief different from the relief sought in its earlier-filed district court action, and thus 28 U.S.C. sec. 1500 does not divest the Court of Federal Claims of jurisdiction.
