Holton v. Shinseki, 08-7081

In a dispute over disability benefits, Court of Appeals for Veterans Claims denying plaintiffs' claims for disability compensation is affirmed where: 1) plaintiff Holton failed to demonstrate that his injury was causally related to any in-service injury he suffered; and 2) co-plaintiff Bryant's claim failed to show show that he incurred his condition during active service or that his current condition is causally related to his military service. The presumptions in favor of veterans in 38 U.S.C. sections 105 and 1110 were not enough to overcome the lack of causal connection.
