Delalat v. Dep't of the Air Force, 08-3038
In an appeal of a Merit Systems Protection Board action, denial of plaintiff's petition for review for lack of jurisdiction is vacated and remanded where reemployed annuitants are considered employees for purposes of the Federal Employees' Compensation Act (FECA) and are entitled to a statutory right to restoration, and therefore have a statutory right to appeal to the Board.
