In a breach of contract action, Court of Federal Claims ruling that plaintiff committed fraud is affirmed, where: 1) the finding that plaintiff made a claim under the Contract Disputes Act is not clearly erroneous; 2) plaintiff made a fraudulent claim and the court properly assessed penalties under the Contract Disputes Act and the False Claims Act; and 3) plaintiff's affirmative claim for damages against the defendant were forfeited due to their own fraud pursuant to 28 U.S.C. section 2514.
