United States Federal Circuit
Agrizap, Inc. v. Woodstream Corp., 07-1415
Sufficient evidence supports a jury's finding of fraudulent misrepresentation in favor of an electronic rodent-killing device patent holder where the appellant failed to overcome the jury's finding of sufficient evidence of fraudulent misrepresentation under Pennsylvania's 6-factor test. However, the holder's patent claims are ruled invalid for obviousness where the use of an animal body as a resistive switch to complete a circuit for the generation of an electric charge was already well known in the prior patents.
