Dearchibold v. US, 07-1032
In a suit alleging that the U.S. is liable for amounts due to plaintiffs under Panamanian labor law as a consequence of plaintiffs' employment with the Army Air Force Exchange Service, dismissal for lack of subject matter jurisdiction is affirmed where: 1) executive agreements between sovereign nations are not "express contracts" within the meaning of the Little Tucker Act, thus the U.S. did not waive its sovereign immunity; and 2) the executive agreement in question did not explicitly waive sovereign immunity.
