L.B. Plastics, Inc. v. Amerimax Home Prods., Inc., 06-1465
In a suit alleging infringement of a patent for a rain gutter guard, summary judgment of noninfringement is affirmed where: 1) the district court properly granted summary judgment on the issue of literal infringement since it correctly construed the term "welding" in the patent as excluding attachments with hot glue; and 2) plaintiff could not invoke the doctrine of equivalents since a person of ordinary skill in the field of the invention reading the patent specification would clearly conclude that the inventor thought that adhesive attachments generally were undesirable.
