Wheatland Tube Co. v. US, 06-1524
In a suit over the Dep't of Commerce's determination of a Thai exporter's antidumping margin after Commerce's interpretation that safeguard duties are not deducted from the export price in calculating the antidumping duty margin, the Court of International Trade's determination that Commerce's interpretation was unreasonable is reversed where the trial court's reasoning was insufficient to overcome the deference that should have been accorded to Commerce's interpretation, which was clearly reasonable and the result of a formal and thorough administrative rulemaking process.
