In re Metoprolol Succinate Patent Litigation, 06-1254

In a consolidated multidistrict patent infringement litigation alleging that defendants' Abbreviated New Drug Applications violated plaintiff's patents, summary judgment for defendants is affirmed where plaintiff's patents were invalid and unenforceable based on obvious-type double patenting. Summary judgment for defendants is reversed and remanded where a genuine issue of material fact existed in regards to plaintiff's inequitable conduct claim.
