United States Federal Circuit

Harms v. Nicholson, 2007-7005

In an appeal arising from a denial of a veteran's claim for service connection for post-traumatic stress disorder and a subsequent denial of a motion to vacate the decision, dismissal of claimant's appeal for lack of jurisdiction is affirmed where: 1) the Court of Appeals for Veterans Claims properly determined that timeliness for motions for reconsideration and requests to vacate both invoke the 120-day statutory period in 38 U.S.C. section 7266(a) that defines the court's jurisdiction; and 2) consequently, claimant's appeal was not timely filed.
