United States Federal Circuit

Wechsler v. Macke Int'l Trade, Inc., 05-1242, 05-1243

In a patent dispute involving a portable device for carrying and dispensing water for a pet, grant of judgment as a matter of law (JMOL) that individual defendant was personally liable for inducing infringement of the patent at issue is reversed where the district court improperly disregarded the jury's special verdict. Also, denial of JMOL on an award of lost profits is reversed where the jury's award was not supported by substantial evidence.
