Carabetta Enters., Inc. v. US, 06-5037, 06-5043
In a contract dispute with the government brought by plaintiffs, owners and managers of properties that have provided low-income rental housing under several HUD-sponsored programs, summary judgment holding the government liable for breach and an award of damages are affirmed where: 1) the government was liable under the original, unmodified Repayment Agreement between the parties; and 2) the trial court correctly rejected plaintiffs' damage claims for certain expectation damages.
