Walter Kidde Portable Equip., Inc. v. Univ. Sec. Instruments, Inc., 2006-1420
In a case involving a patent for a type of smoke detector, grant of plaintiff's motion for voluntary dismissal without prejudice is affirmed where: 1) although the district court erred as a matter of law in dismissing defendant's counterclaims over its objection and in ruling on a motion for voluntary dismissal without first determining whether it had subject matter jurisdiction, the errors were harmless; and 2) there was no abuse of discretion in the grant of dismissal.
