N. Star Steel Co. v. US, 06-5054, 06-5057
In a suit brought against the government by a manufacturer of steel products for breach of a contract involving power-transmission payments, a judgment awarding the manufacturer $1.5 million as a third party beneficiary is reversed where the district court's findings of fact did not, as a matter of law, support its holdings that: 1) agency breached the contract of which plaintiff was a third party beneficiary; and 2) plaintiff agreed to an amendment to the relevant agreement under duress.
