United States Federal Circuit
Lebeau v. US, 06-1072
In a class action brought against the government under the Little Tucker Act for breach of trust based on what plaintiffs asserted was the Secretary of the Interior's unreasonable delay in distributing to them their share of the Mississippi Sioux Tribes Judgment Fund, an award for plaintiffs is reversed where the district court erred in its determination that plaintiffs were entitled to money damages as a result of the Secretary's breach of trust.
