Padgett v. Nicholson, 06-7037
In the context of claims for service-connected disability benefits, where a veteran dies after his case is submitted for decision, but before the opinion issues, the Veterans Court has authority to issue the judgment nunc pro tunc as of the time of his death. Also under such circumstances, the surviving spouse, as accrued-benefits claimant, may be substituted on her husband's appeal.
