L & W, Inc. v. Shertech, Inc., 06-1065, 06-1097

In a suit brought by a manufacturer of heat shields for automobiles seeking a declaratory judgment that it did not infringe defendant's patent and challenging the patent's validity and enforceability, a judgment of infringement against plaintiff on a particular claim is vacated where defendant failed to satisfy its burden of showing that there was no genuine issue of material fact on the issue of infringement. However, rulings on claims' respective validity and invalidity are affirmed, as well as a judgment holding that the patent was not unenforceable due to inequitable conduct.
