United States Federal Circuit

Qualcomm Inc. v. Nokia Corp., 06-1317

Denial of Nokia's motion to stay litigation with plaintiffs involving a license to patents having to do with mobile telecommunications standards, pending arbitration, is reversed and remanded where: 1) the parties clearly and unmistakably intended to delegate arbitrability questions to an arbitrator; and 2) a remand was necessary for a determination as to whether defendant's assertions of arbitrability under the an agreement were "wholly groundless."
