United States Federal Circuit

Int'l Custom Prods., Inc. v. US, 05-1444

A decision of the United States Court of International Trade, which asserted jurisdiction under 28 U.S.C. section 1581(i)(4) and held that the United States Bureau of Customs and Border Protection violated 19 U.S.C. section 1625(c)(1), is reversed as to its jurisdictional holding as the remedy provided plaintiff by an other subsection was not manifestly inadequate so as to permit jurisdiction under section 1581(i)(4), and the ruling on the merits is vacated.
