In a case involving patented biotechnology, grant of plaintiff's motions for summary judgment of patent invalidity and infringement, antitrust violations and patent misuse, and common law counterclaims, and an order granting a permanent injunction is affirmed in part and vacated in part as to the grant of a permanent injunction and remanded for reconsideration in light of the Supreme Court case, eBay Inc. v. MercExchange, L.L.C., 126 S. Ct. 1837 (2006).
