Because the district court erred in its claim construction of patents that claim the interlocking features of masonry blocks that can be stacked to form retaining walls, that portion of its judgment is reversed. The district court erroneously concluded there was a complete bar to application of the doctrine of equivalents pursuant to Festo Corp. v. Shoketsu Kinzoku Kogyo Kabushiki Co., 234 F.3d 558, vacated and remanded, 535 U.S. 722 (2002).
