WHITE v. DEP'T OF JUSTICE, 02-3329

A corrections officer's simple assault conviction was for a misdemeanor crime of domestic violence under 18 U.S.C. section 921(a)(33), and a warden correctly concluded that the officer was prevented by 18 U.S.C. section 922(g)(9) from meeting the requirement that he be legally eligible to carry a firearm, thus the officer's removal is affirmed.
