CARREON v. OFFICE OF PERSONNEL MGMT., 02-3263
Because plaintiff's "indefinite" appointment and subsequent employment met the statutory requirements (5 U.S.C. section 8342(a) (2000)), and because his right to annuity benefits was eliminated by the receipt of a lump sum payment for previously withheld funds, the Board correctly determined that plaintiff was not entitled to retirement benefits under the Civil Service Retirement System.
