United States Federal Circuit
LASALLE TALMAN BANK, F.S.B. v. US, 00-5005/5027
The Court of Federal claims was correct in crediting actual profits after a breach implicit in enactment of the Financial Institutions Reform, Recovery and Enforcement Act of 1989, in mitigation of injury caused by the breach, but the court erred in including unrelated activities and profits thereon as contributing to the mitigation.
