GENENTECH, INC. v. AMGEN, INC., 01-1098

Because the district court relied on an erroneous claim construction in granting defendant's motion for summary judgment, finding of infringement of a patent, which claims methods and cloning vehicles for the introduction and expression of genetic information, vacated and remanded for a determination of infringement under revised claim construction.
