BOEING N. AM., INC. v. ROCHE, 01-1011

Because the Armed Services Board of Contract Appeals applied the wrong legal standard when disallowing contractor's legal costs of defending a shareholder derivative suit, and failed to make an assessment of the contractor's likelihood of prevailing in its defense of the suit, judgment vacated and remanded for further proceedings.
