Cruz v. McAleenan, 17-5113
Reversed and remanded. An African-American female of Hispanic national origin formerly employed by the Department of Homeland Security alleged discrimination and retaliation by the agency. The District Court erred in granting summary judgment to DHS before discovery could be conducted because the evidence sought by the plaintiff would create a dispute of material fact as to whether DHS's proffered reasons for taking action were pretextual.
