Temple University Hospital, Inc. v. NLRB, 18-1150
On petition for review and cross-application for enforcement of an order of the National Labor Relations Board, Defendant’s petition granted and the Board’s cross-application denied. The NLRB erred in assuming arguendo that judicial estoppel applied when making its determination. Remanded to determine whether judicial estoppel applies in proceedings before the NLRB.
