Calhoun v. Johnson, 09-5315
In an action against plaintiff's employer, the General Services Administration (GSA), claiming discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964, summary judgment for defendant is affirmed in part where, under these circumstances, and considering her far more limited real estate experience, the district court correctly held that plaintiff's claims regarding the GSA Office of Real Property positions could not survive. However, the judgment is reversed in part where the evidence is sufficient for a reasonable jury to conclude that plaintiff's supervisor knew plaintiff would likely be a candidate for the position, and thus to reject the argument that he could not have knowingly discriminated against her.
