Al-Adahi v. Obama, 09-5333

In a habeas petition by a detainee at Guantanamo Bay Naval Base, the grant of the petition is reversed where: 1) assuming arguendo that the government must show by a preponderance of the evidence that petitioner was part of al-Qaida; 2) the district court clearly erred in its treatment of the evidence and in its view of the law; and 3) when the evidence is properly considered, it becomes clear that petitioner was - at the very least - more likely than not a part of al-Qaida.
