The district court's order that defendant be retried on charges arising out of defrauding the September 11th Victim Compensation Fund is affirmed in part where a retrial on false claim and theft counts would not require the government to relitigate any issue that the jury necessarily decided in defendant's favor. However, the order is reversed in part where the Double Jeopardy Clause barred defendant's retrial on certain mail fraud counts.
