US v. Perez, 08-3073

Defendant's conviction for drug possession with intent to distribute is affirmed where: 1) the statements of defendant's counsel, considered along with defendant's understanding of the proceedings against him and his ability to assist counsel before and during trial, precluded reasonable cause to believe defendant was incompetent to stand trial; and 2) the record conclusively showed that defendant could not prevail on his ineffective assistance claim.
